Section 65
<br> that cases can be heard without court fees
Notwithstanding anything contained in section 64, in any of the following cases, the judge may order the filing of a petition, appeal, counterclaim, or review or rehearing of the case, fully or partially after court fees, with a statement of reasons:-
(a) If the person who has to pay the court fee is unable to pay the court fee in whole or in part due to his financial condition being extremely weak, if there is any reasonable basis to be believed while examining the application made in the court,
(b) If it is recommended by the concerned local level that the person who has to pay the court fee has no property other than the property in question and is unable to file the court fee, or if there is a reasonable basis to believe when the report of such a person is examined by the court.
(2) According to sub-section (1), if the judge orders to collect the court fee in whole or in part later, the relevant employee shall keep a record of the amount of court fee taken and how much is yet to be collected in a clear written form along with the letter.
